Road Stopping Proposal – Unformed Legal Road 2025
The proposal
Council has received an application from G and Jo Limited for a road stopping of road that is not sealed and it does not have a name. They wish to purchase the land containing the legal road to include it within the eco-sanctuary they are establishing. If the road stopping is successful, the road land will be amalgamated with their property at 362A -C Paekākāriki Hill Road held in Record of Title 18882.
Road stopping is the process undertaken to change legal road (commonly known as road reserve) into fee simple land so that it can be sold.
The road subject to this request adjoins or passes through the properties legal described as Lot 2 DP 304740; Lot 3 DP 304740; Lot 4 DP 304740; Lot 1 DP 41131, Lot 2 DP 41131; Lot 3 DP 41131; Part Lot 2 DP 8107; Lot 12 DP 610; Lot 1 DP 8760; Section 10 SO 466867 and Lot 2 DP 77897 as shown on the plans below.
The unformed legal road subject to this request does not adjoin formed legal road and due to the topography of the unformed legal road physical access is difficult.
The road stopping process is being undertaken in accordance with the section 342(1)(a) and the Tenth Schedule of the Local Government Act 1974.
Next steps
If objections are received, the Council will have a hearing for the applicant and to hear the applicant and persons who have objected to have their concerns heard.
Council must then decide whether or not they will uphold (support) the objections. If the objections are upheld, then the road stopping cannot proceed and the process concludes.
Once an objection has been received, and unless the Council decides to uphold it, it must be referred to the Environment Court.
It is not open to the Council to disregard an objection or negotiate a position that results in an objector agreeing to withdraw their objection. The matter will still need to be referred to the Environment Court because once an objection has been received, unless the Council determines to uphold it, the jurisdiction to approve it lies with the Environment Court, not the Council.
The Environment Court may hold a hearing or may be able to arrange mediation to resolve objections before a hearing.
